General Terms and Conditions of Sale of FASHION FACTORY Sp. z o.o.
Below is the full text of the General Terms and Conditions of Sale of Fashion Factory Sp. z o.o.

 1. Claims
All claims must be submitted within 8 days from the date of receipt of the goods, at the recipient’s risk and expense, even if the goods were shipped freight prepaid. Claims must be submitted by email within this time frame.

2. Shipment
Unless otherwise agreed, all shipments are made at the buyer’s expense and risk.

3. Payment
Unless otherwise specified in the invoice, all invoices are payable strictly within the time frame specified in the invoice, in favor of Fashion Factory Sp. z o.o. In the event of missing payment within 8 days after the due date, a fixed compensation of 15% (minimum €50) will be automatically applied without prior notice of default, in addition to late payment interest of 1% per month, calculated from the date of the unpaid invoice. Price changes or discounts not previously agreed in writing are not accepted and apply only if payment is made on time. Payment dates indicated on checks must adhere to the same terms unless otherwise authorized and agreed upon with the company.

4. Retention of Title
The sold goods remain the property of the seller until full payment of the price, including the principal and all additional charges.

5. Delivery Date
Delivery dates are indicative and not binding for the seller; any delays do not entitle the buyer to compensation or contract termination. The seller may cancel delivery under special circumstances (e.g., lack of materials, buyer’s insolvency, territorial exclusivity of other clients) without any right to compensation.

6. Cancellation or Withdrawal
An order may be canceled within 10 working days. If the buyer cancels after this period, the buyer should pay the seller compensation amounting to 30% of the order value (minimum €500). If the actual damage exceeds 30%, the full amount of the damage may be claimed.

7. Colors and Shades
Exact reproduction of sample colors or displayed models is not guaranteed; minor variations in shades may occur.

8. Sales Prices
Prices indicated in price lists or order confirmations are for reference only and may be changed at any time. In case of any revision, the buyer will be informed. All prices are exclusive of VAT and other applicable taxes, which are always payable by the buyer.

9. Cash on Delivery (COD)
For orders under €1,250 (excluding VAT and delivery charges), the seller reserves the right to deliver on a COD basis. Collection fees are borne by the buyer. Choosing this payment method incurs an additional fee of 5% of the total amount to cover processing costs.

10. Jurisdiction
All disputes shall be subject exclusively to the jurisdiction of the court at the registered office of Fashion Factory Sp. z o.o.

11. Personal Liability
In addition to the purchasing company, the individual signing the order also bears personal and joint liability for each purchase.
